Judge Denies Bird Rock Bandit Cravens Motions

Seth Cravens’ attorney, Mary Ellen Attridge moved on Monday for dismissal of Murder charges against her client in the death of Emery Kauanui. Attridge ask the court to reduce the Murder charge, stating the facts do not support Murder.
Defense also stated that Kauanui’s death was not the “natural” result of Craven’s punch. She added that there was no malice in the attack, and maintains that Prosecution had insufficient evidence to support a Murder charge.
The Prosecution disagreed. Deputy District Attorney Sophia Roach asserted a jury should decide whether the defendant was guilty or not of murder stating that “group beatings” can constitute Second Degree Murder.
The Judge also denied another motion to reduce a second charge to a misdemeanor. That incident was reported only after Kauanui’s death. The Judge also ruled out dismissing a charge of Criminal Threat, when it was alleged that Cravens told a passing driver he would return and “fucking kill you.”
Cravens remains in custody at San Diego Central Jail. Bail for Cravens is set at $1.5 Million. His next court date is on Aug 22 at 9am [see updated below] in Central Division Court #58.
Sentencing for Eric House, Orlando Osuno, Matthew Yanke, and Henri “Hank” Hendricks is set for September 6 in San Diego Superior Court before Judge John Einhorn. House, Osuna, Yanke plead to Manslaughter; while Hendricks plead guilty to Accessory After the Fact.
