Oceanside PD — clueless or corrupt?

Today the Oceanside Police Department denied a request for the recordings of the 911 call of Rachel Silva or Frank White. As you may recall, both were involved in an argument on March 15, 2008 in which Rachel Silva and her son were both shot by off-duty San Diego Police officer Frank White, in a Lowe’s parking lot here in Oceanside.
Sixteen days since the incident occurred and we have little to no info. Worse OPD is now undermining the confidence most of us had in the department. The city council however is behaving like puppets which is what we expect from them.

Oceanside Police refuse to release 911 tapes of March 15. It never stops The police seem to be under the impression we work for them.
On the other hand Silva STILL has not given a statement, while Officer White and his wife — who was traveling with him — have given statements. The son has also given statement to police. However I am guessing that will be thrown out in court.
The San Diego Union Tribune, ever watchful of a chance to pretend to be a moral authority says: Oceanside cops should be ashamed of this sham. However the UT is silent most of the time on the corruption of it’s own city, so it’s difficult to take them seriously on much of anything.
Mind you, it’s painting with too broad a brush to exclusively blame the OPD for the stone wall surrounding the March 15 shooting of an unarmed woman and her 8-year-old son by an off-duty San Diego police officer.
There appears little doubt that District Attorney Bonnie Dumanis is pulling the strings. Like a compliant doll, the Oceanside Police Department is doing the bidding of law enforcement brethren to the south.
Well that explains it. The anti-Bonnie Dumanis UT is on the attack, again. The UT goes on about the “sham” of a news conference by the OPD.

He has essentially called this a cover-up. I don’t necessarily agree, however it seems that cops are getting special treatment in O’side.
Could it be that the Union that represents BOTH departments is blocking the action of one department to help another? Considering Union behavior I would have to say: no it does not seem far fetched.
Rachel Speaks, finally, sorta
Silva says that she was not drunk while she was driving March 15.
An Oceanside police spokesman has said Silva was given a toxicology test and White wasn’t. The spokesman generally said the toxicology tests are given only if someone displays symptoms of intoxication.
I will believe that when I see the test results.
She said she doesn’t recall how the confrontation with White started, or if there was an argument. “We were both stopped,” she said. “I don’t know how or what happened.”
So you don’t remember anything, and we are to believe you were NOT drunk? You still have not given a statement to Police, and yet we are to believe you? Yea, right.
Silva also said she is baffled about why White fired into her car. “I don’t understand that,” she said. “Five rounds, I mean, that’s deadly force.”
Why are you commenting? You don’t remember what happened? You can’t say that you were not an hysterical nut trying to run him down with your car. Why are you running your mouth?
She excuses her driving saying she had to pick up her son. Seems to me that is exactly what she should not have been doing. Take a bus, that is why the liberals keep stealing our money to run them.
Silva said that, to her, five shots is attempted murder. “Anyone else would be in jail right now,” she said. “And he’s just walking around.”
I wonder if she would say that about her drunk driving? I do.
Oh, and Silva also claims that she does remember she did not argue with White.
“She didn’t attack him. She didn’t threaten him,” Gene Iredale, an attorney for 27-year-old Rachel Silva, said yesterday. Silva’s 8-year-old son, who was with her in her car, was shot in the leg. Both were released from the hospital March 19.
First she can’t remember, then she remember something that exonerates her, and yet were are to believe a two time loser who was flagrantly violationg the law? Who STILL HAS NOT given a statement to police. Oh but she has time for press conferences, and lawsuit filing, and complaint filing. Yes, she is so believable.

Silva’s CHILD was QUESTIONED without the notification of either parent and over the objections of the child’s uncle. Not the same as GIVING a statement, more like a statement was ripped from the child by two cops. Silva BY LAW does not have to give a statement and decided not to give the team that shot her and her child one. She’ll give her statement in court.”

Travis says, “You think she HAD to be drunk. On the other hand I think she was in sever shock. Let’s see, she just saw a man with a gun try to kill her child for no reason, bullets flying everywhere she was shot twice, one slug shattering her arm bone (thats gotta hurt), she lost a lot of blood. Then the uniforms show up and treat her instantly like a criminal. In the same circumstances most of us would be lite headed.”
Nice try Travis. It’s 16 days and STILL NO STATEMENT. She did have time to study up on police procedure and recommend wholesale changes to off-duty police procedures. Damn! That usually takes years to master. She had time to file a complaint with the help of two attorneys. She has no excuse.
Her son seems to have no issue recalling what happened, he was shot and saw his mom shot. Hmmm.
She is a criminal. Two time loser (which means she was caught at least twice — no doubt a small portion of the transgressions — and finally made to answer at the level that was appropriate) and was flagrantly violating the law. Her excuse that she HAD to pick up her son is bull-crap. Are we to believe that she did not take her son to her friend’s house, or that they would not have dropped him off? Are we to believe she has not been violating the law for the last 3 months almost daily? Yea, right.
She is now gaming the system.
As for the statement by the son, it most likely will be challenged BUT HE IS NOT A SUSPECT so it will most likely stand.
As for officer White having an attorney present that is his right. Silva has had an attorney for 15 days now, actually two that we know of; and STILL NO STATEMENT.
It’s clear she has something to hide, and I believe she is lying. On the other hand OPD is not helping things with the stonewalling for information.

You are throwing some pretty wild propaganda out. I assume you are just trying to get a rise out of people. None the less I’ll take a swing at it. You claim that she has studied “police procedure.” I think most reasonable folks would realize that knowledge came from her lawyer, who has probably spent years doing research.
STILL NO STATEMENT. You say, “She has no excuse.” But she DOES have an excuse. Just because you and the cops want a statement doesn’t mean shit. Only a judge can force her to talk. If the road raged law man was a better shot and had killed her would you still be waiting for her statement? If the detectives don’t know what happened by now then lets turn the case over to Nancy Drew.
You go on and on and on about her “record,” but what does that have to do with the shooting. Even if she was drunk when did we start having our patrol offers execute drunks? Notice how the quickly the “tight lipped” department released her info. Have they told us about the gunman’s disciplinary incidents? How many other children has he tried to kill? Oh no, that might jeopardize the investigation. The cops are clearly trying to make her look bad to protect their brethren.

Where did you find that info? Please share as I would like to know what he said. For all I know he said “Go to hell for trying to kill my mommy.”

How can he know what is right and wrong here, especially when his star witness has no clue what happened. So she says — more sarcasm –, and watching the video, I am not buying her “act”.

This attoney is no personal injury lawyer with a daytime commercial deal. This is a respected A rated attorney that is trying to get himself on a Johnny Cochran or F. Lee Baily level. (but reversed) San Diego will have to shell out some major bucks to defend themselves against this money and fame hungary j–b—–!! Silva will need all the money she can get so she can run and hide from SDPD for the rest of her life. I hate to see scum like her getting tax payers money because an over zealous cop screws up.
So K, if she is innocent then why does she have a “defense” attorney? Seems a lot of people don’t want to answer that question. It also seems odd to me that the first attorney she called, was NOT a “defense” attorney but a “personal injury” attorney. Yea, sure; she is a pooowwwhh widdle hehplass viktomb. Bull.

Dear Mark, Seriously, a woman and her son(both humans) HAVE BEEN SHOT! Regardless of whatever underdeveloped political issues that anyone has, a crime was commited. 2 people were shot. The officer wasn’t on duty and wasn’t investigating anything. He shot an 8 year old. An unarmed innocent 8 year old boy. Don’t belittle the situation. People make mistakes and the mistakes that this woman made DOESN’T matter in this case. SHE WAS SHOT!!!!

Should the officer let her run him down BEFORE shooting her? That seems to be your attitude. Because a “woman and her son (both humans) HAVE BEEN SHOT” the cop is automatically guilty. It’s clear that the cop is not a Human in Allen’s (and other’s) view. How sad that some can not even see how stupid is that thinking.
The “fact” that an 8 year old boy was shot means nothing other than an 8 year old boy was shot. You think it means that the officer is automatically guilty, and some nefarious activity is afoot. Congrats you have proven that the attorney for Silva is correct in assuming that people like you will suck up his pablum.
Forget her past, forget her current transgression, forget that the Justice system has given her numerous chances, ignore that she was going to injure her child eventually, ignore that fact that she is acting like a typical criminal, ignore that she has refused to give a statement, ignore that she doesn’t remember anything yet she can file a claim — so she can sure later –; forget all of that they demand. You must forget all of that and send them cash, now. No trial, no statement, no facts, no nothing other than emotional outcries; send cash, now.

I don’t care how bad they’re driving, NOBODY deserves to have their kids and theirselves gunned down by anyone…much less a cop.
