Drunk Rachel Silva Demands Cops take Pysch Evals

No, I am not kidding. A women who has two DUI convictions and was out driving on a suspended license has decided that cops need to be evaluated for psychological issues. Oh yeah, this same “good citizen” has still NOT talked to police about the incident to which she filed a complaint about today. Unreal, the arrogance of some people.

She doesn’t have time to speak with investigators, but she has time to file what appear to be dubious claims and blame the cops.

A woman who was shot twice by an off-duty San Diego police officer after a traffic dispute filed a claim Wednesday against the city seeking unspecified damages.

Rachel Silva also wants the city to begin psychiatric testing of its police officers and regulate or restrict off-duty officers from carrying loaded weapons.

Unreal. How about we put her dumbass in prison for driving a loaded weapon? Sounds good to me.

Silva said in her filing with the city that she suffered psychological distress and physical injuries. She claims the city failed to properly screen, train and discipline its officers.

San Diego City Attorney Michael Aguirre said his office is reviewing Silva’s claim. The county district attorney’s office and Oceanside police are also reviewing the case.

The San Diego Police Department said, “We expected a claim such as this and we are prepared for it.”

What tipped you off, the fact that she did not talk to Oceanside PD, before hiring not one, but two attorneys? Pretty much sealed the deal.

The shooting happened after one vehicle cut another off around 9:15 p.m. on March 15. White was driving his own car and was accompanied by his wife, a dispatcher for the Carlsbad Police Department.

White has been interviewed by investigators, but Silva has declined to provide a statement to police.

Oh yea, that’s how an innocent person behaves. You refuse to speak to police and then lawyer up so you can file a claim against the PD.

According to the account Silva provided with her claim, she and White were screaming at each other when [they] reached the mall parking lot. White pulled up on the right side of Silva’s car and began firing, hitting her son in the passenger seat and shattering her right arm as she reversed to get away.

[MARK: March 26, 2008 -- the police have said that there was one bullet hole on the passenger side window and four in the windsheild.]

Her attorney, Eugene Iredale, said Silva’s ex-husband, a Camp Pendleton Marine who flew home from his deployment to care for their son, may file a similar claim on the boy’s behalf.

Silva was unarmed at the time of the shooting.

Other than the car she was driving. [UPDATE: who said she was "unarmed"? I find it odd that the media would say this. Seems they have chosen a side. Watching the video proves that.]

I so agree Goddess. Even better is that she is now an expert in policing and is giving advice on how to handle personnel in a PD when she can’t even handle her own life properly.

I love the blame the victim mentality. She is obviously no angel and she should have let the fact she was cut off go. To follow a possible nut case with your kid in the car is stupid. That does not excuse the hot head cop from pulling a gun and shooting. She was trying to back up and get away and he is still shooting. He should be in jail. She probaby insulted him and possibly his wife and he blew up. Police officers should have good self control considering their responsibilities.

Its scary to me that so many people are lambasting Rachel Silva … you’re the only one that sees it correctly … she was wrong to drive on a suspended license, I have not seen anything saying she was intoxicated but there are no circumstances that I’m aware of that rationalizes his behavior and for me just as disturbing is the lack of transparency by the police and DA.

This is despicable and should be on national news … this gives a whole meaning to “fraternal order of police” this is more like a gang.

Paula, were you a witness? If not, then how do you know she was cut off? Even so, would that make it o.k. for her to point a car — a weapon btw — at someone and try and run them down? (you don’t know she didn’t do that, she claims to not know what happened. Like every criminal does)

Since you were not there, how do you know she is a victim? Oh the big bad PD is to blame in your world for everything?

BTW Paula, self defense is still legal in this country, at least until you and FrankOB can stack the courts.

As I was instructed in weapons training. 1. when shooting someone empty your gun 2. never shoot to “stop”, shoot to kill 3. when ask why you shot “X” times; respond:”I ran out of bullets.”

Must be nice to arm chair quarterback from the comfort of your hooka equipped rec-room.

As for the DA and OPD, well considering the “ambulance chasers” who come out of the woodwork like cockroaches when this type of event happens; would you be putting out any info? Especially when one of the participants has a history of drunk driving and flagrant law breaking; AND SHE WON’T TALK. Guess what, her attorney knows this is why they won’t release anything, and he is playing it to the hilt.

I find it funny that all the cop-haters have yet to demand that she do what any of us would do; give a statement. It appears to me that she won’t talk because it hurts her case, and she puts herself in postion of being charged with perjury later on. Funny how none of you even consider she may be lying.

Did it ever occur to any of you that she just wants to stay out of prison?
