Yes you read that right. People, not “The People”, just people in general. Court says People win over Seals. No doubt that Judge is now on an ELF hit list, now.
LA JOLLA β A state appellate court yesterday upheld a judge’s 2005 order requiring the city to restore water quality to Children’s Pool beach in La Jolla by dredging the bacteria-laden sand and shooing away a colony of harbor seals.
Finally, the damn seals have to bend for us. [read about the Children's Pool here] No doubt the Enviro-wackos are in a weekend long strategy and Tofu session to fight the win by People.
βIt’s a huge setback,β said Bryan W. Pease, an attorney for the San Diego-based Animal Protection and Rescue League.
City Attorney Michael Aquirre, local gadfly and motor-mouth said he will appeal the decision. My guess is that his decision is two-fold. The first he wants to be seen as fiscally responsible. Not a difficult task in San Diego. The second is he wants to get some of the left-wing-nutball-envirowacko vote so prevalent here in California. Yes, ol’ Mike is surely bucking for higher office.
So why is this a big deal?
Public health officials have posted high-bacteria warnings at Children’s Pool since 1997. Genetic tests confirmed the seals were the source of the contamination.
Yea, those lovable Seals are contaminating the Children’s pool. Liberals — who always use children, but never protect them — are on the Seals — aka polluters — side. Gee what a shock.
Yesterday’s ruling reaffirms a decision by Superior Court Judge William C. Pate. He ruled that by allowing the cove to become polluted by seal feces, San Diego had violated the terms of a 1931 trust transferring ownership of the beach from the state to the city.
The trust requires the city to maintain Children’s Pool exclusively for recreational purposes and as a public park and swimming area for children.
The city of San Diego, of course is not sticking to it’s agreements. That’s about par for the course in San Diego.
Gabriel Solmer, an attorney for San Diego Coastkeeper, said the appellate ruling incorrectly removes the city’s authority and flexibility.
Sorry Gabby, it does suck to have to stick to your word. You would think we lived in Santa Monica, the way these nuts are talking.
A side note. Anyone ever notice that animals seem to have better attorneys that most humans? Seems that liberals would be more concerned about their own kind, based upon their positions about homelessness, and crime. Since they love to take up for criminals, why not spend that money defending them? Maybe they don’t like criminals anymore than we do?

I am actually commenting on a post in your old blog, about the breastfeeding mother who was ticketed on the beach.
1. She was protected by law to nurse her baby where she was.
2. She was fully covered up, under towels & an umbrella.
3. Babies need to eat. Breastmilk is best.
4. Breasts are designed to feed babies. There is nothing indecent about nursing our young. It is our small-minded society that has overly sexualized the breast. Have you been offended by old images of nursing Madonna as well?
Please get yourself educated on this subject.
I know of no place that allows public display of breasts with the exception of “clothing optional” beaches, such as Black’s Beach in San Diego.
The law in Colorado says that a women may breast feed in any place she has a right to be. It does not say that exposing yourself is legal. No doubt this law will be struck down as overly broad and infringing upon the rights of others.
Beyond that, why is she at the beach with a baby in the first place. I would think that someone so concerned with a baby’s health would question the actions of the mother.
