Accused killer Matthew Yanke was released on bail. He immediately went to a rehab center. Gee what a shock.
Matthew Yanke, 20, made bail Thursday night with the help of “family resources,” said his attorney, Kerry Steigerwalt.
“He realized this situation never would have happened had alcohol not been involved,” Steigerwalt said. “Consequently, he has placed himself into a long-range rehabilitation program.
Yeaaaa, it’s the booze. Somehow I seriously doubt that.
“(Yanke) is also seeking counseling to help deal with the loss of his friend. He had known the victim since his sophomore year” at La Jolla High School, the attorney added.
His friend! He knew him in High School, and that makes you friends? Oh man this attorney is good!
The three others charged in the May 24 fatal beating of [Emery] Kauanui, 24, [Ed: outside his mother’s home] remained jailed last night, authorities said. Bail is set at $2.5 million for Seth Cravens, 21; $2 million for Eric House, 20; and $1.5 million for Orlando Osuna, 20.
The defendants, who claimed on MySpace profiles to be part of a “crew” of hard-partying surfers called the Bird Rock Bandits, pleaded not guilty to murder in Superior Court on Thursday. They face 25 years to life in prison if convicted.

The area this happened in, is known for surfer losers, under-age drinking, and rampant drug use. It also is known for crappy Police enforcement. It appears that the bars are willing participants in the under-age drinking, and many say they know it.
It’s clear these are spoiled rich kids, and thought they could do anything. Parents, teachers, and the government are failing our country and destroying our future. Unions have destroyed public schools, and Parents just don’t want responsibility. Good job, liberals.

The beating of Emery was not the first time the “Bird Rock Bandits” were reported to the police. According to postings on sigonsandiego.com, a man named Michael Johnson was attacked on the night of May 8th after trying to break up an altercation in front of “The Shack”–a bar in La Jolla. Johnson claims he was sucker punched, and when he went down, was kicked repeatedly while on the ground. Johnson reported this incident to the police and even went to the La Jolla high School to identify his attackers from yearbook photos. He identified Cravens as one of his attackers, and went to the police. The police, however, said they would not be able to do anything for 10-14 days. Said Johnson on the Web site, “I gave them names. I had photos of my face all purple and bruised. It was so frustrating, and then I learned about Emery’s death. If the police had followed up after I made my report, at least these guys would have been on notice and maybe Emery would still be alive.”
Yea once again the SDPD is on top of things.

I was actually in rehab with matt yanke and I have to tell you he never through a punch or even hit the kid. And the victim actually instigated all this. He was struck knocked out before he hit the ground due to a lucky punch and died of his injuries related to his head striking the ground. This was a terrible accident that ruined many lives and is in no way a murder.
No surprise that we are hearing the “victim is at fault” excuse. It’s difficult to buy that from someone who runs to rehab before his case gets to court. No that doesn’t look at all like it was planned or manipulative. No, not at all. Nor can I imagine that he scripted his conversations while in rehab. No, that’s just not possible. They were such good kids.
Anyone buying the “he started it” line? Not me.
Oh and just so you know, if you agree to fight and someone dies; it’s still manslaughter. Agreeing to fight does not remove the responsibilities of your actions. If they had stepped into a ring and had oversight, then they can argue it was an accident.
Beyond that, if they had agreed to fight, then why did they run?
